April 2014: EQUAL PAY PAYMENTS

All outstanding claims are being dealt with by Thompsons Solicitors. Members awaiting information on existing claims should contact Thompsons directly.

15/11/12: EQUAL PAY PAYMENTS
We are still awaiting information on the likely timetable for payments being made. Our information at this stage is that it may take several months for all payments to be completed because of the complexity of the individual calculations to be made. We will update here as soon as we know anything.

At this stage, this is a matter between UNISON's solicitors and the council and the Branch Office has no more information than is printed above. As soon as we know anything it will be put up here.

8 Nov 2012: Allegations of delays
Many members are phoning the office stating they have been advised from other parties that UNISON is causing a delay in the payment of equal pay settlements. This is not the case.

The technicalities of settlements are being worked out and UNISON and the Council hope to be able to release a joint statement shortly regarding a clearer timetable.

UNISON WINS EDINBURGH EQUAL PAY DEAL

26 Oct 2012: UNISON wins Edinburgh equal pay deal
UNISON has won an equal pay deal for thousands of council staff in Edinburgh. The union today agreed a settlement with the City of Edinburgh Council after a long-running battle to secure equal pay claims by up to three thousand workers

Note for members with claims: As is the nature of legal settlements, we cannot give details publicly and each settlement for each individual will be different based on the difference between the male comparator, the length of time and several other factors. This is a compensation offer that will be put to you by Thompsons and the Council. The branch does not have details of this and any queries need to go to Thompsons Solicitors.

23 March 2012: The Branch Office is receiving many calls about equal pay claims. If you already have a claim lodged, it is being dealt with by Thompsons solicitors and you need to send any supplementary questions to Thompsons in writing.

EQUAL PAY DEADLINE 5 MARCH 2012

The following letter was sent to all members' home addresses dated 20 February 2012:

"Dear Member

City of Edinburgh Council - Equal Pay

I am writing to advise you of an important deadline for the
submission of equal pay claims. In recent years UNISON has advised
several thousand Edinburgh workers about equal pay and pursued in
excess of 2000 tribunal claims. While we will always assist members
with new equal pay issues the opportunity to back date historic
claims through the UNISON legal service is about to close.

If you have returned a CASE form seeking assistance with an equal
pay issue you can disregard this letter. However, if you have not
returned a CASE form you must act now. The deadline for receipt of
CASE forms is 5.00 pm, Friday 2nd March 2012. Forms should be
returned to:

UNISON Scotland, 60 Belford Road, Edinburgh, EH4 3UQ

The City of Edinburgh Council has indicated a willingness to settle claims for APT&C staff with claims lodged prior to April 2010. We expect to conclude that settlement process over the spring but you should know that individual settlements are a slow and arduous process. If you lodged a claim after April 2010 but prior to the deadline of 5th March we will continue to pursue settlement or tribunal compensation on your behalf. If you fail to claim prior to 5th March you retain the personal right to pursue equal pay on a private basis. Claims should be lodged within six months of the end of the employment to which the claim relates.

10 Jan 2012: The path to justice and compensation has been cleared for hundreds of UNISON members today as Edinburgh City Council abandoned its defence of long running equal pay claims for ex APT&C staff.

Equal Pay

Look out for more equal pay news. Some information for individual members will not appear on these pages because it is confidential and privileged. Equal pay comes into force if jobs predominantly done by women (for example home helps) are of equal value to other higher paid jobs done mainly by men.

UNISON has been fighting for equal pay since its inception but in 1999 we signed a deal (following a ballot) with Scotland's councils to come up with Single Status whereby all jobs would be evaluated in an 'equality proof' way to ensure equal and fair pay.

Why the delay? Councils asked for extension after extension and Edinburgh refused to implement the nationally recommended scheme. Due to councils dragging their heels, more and more women are taking tribunal cases. Edinburgh UNISON alone has a possible 1,600.
